Most importers assume ABF enforcement is rare. In practice, the ABF actively monitors the accuracy of import declarations through its Compliance Monitoring Program, and the penalty tiers for customs declaration errors are steeper than many businesses realise.

How the ABF Responds to Non-Compliance

The ABF response depends on the legislation, circumstances and seriousness of the non-compliance. Outcomes can include correcting the declaration and paying short-paid duty or tax, an infringement notice, or prosecution in serious cases. These are possible enforcement outcomes rather than a fixed three-tier sequence.

Penalty amounts are calculated using the Commonwealth penalty unit system under Section 4AA of the Crimes Act 1914, as published on the Federal Register of Legislation. The penalty unit value is indexed periodically, so the dollar figure that applies to any given offence depends on the date the offence was committed. Under Section 4B of the Crimes Act 1914, a court can impose a fine on a body corporate of up to five times the maximum that applies to an individual for the same offence, which is why corporate exposure is considerably higher. The Five-Year Record-Keeping Requirement

Section 240 of the Customs Act 1901 requires owners of imported goods to retain relevant commercial documents for five years. Those records support later verification of matters such as classification, valuation and duty liability, so accurate record-keeping is essential.

Tariff Classification and HS Code Errors

For electronic declarations, the charge increases once the consignment value reaches AUD$10,000 or more, and documentary lodgements attract higher charges again. These charges apply alongside any duties and taxes payable.

It does not remove liability for short-paid duty or tax, which must still be paid.
